White House Press Secretary Josh Earnest defended President Obama’s comments on gun control in recent days, reminding reporters that the president supported a ban on assault rifles.

“You don’t need an assault weapon to go hunting, it certainly is not part of anybody’s family heritage or family tradition,” Earnest said.

Earnest defended Obama’s comments about gun control, pointing out that he had many conversations with both urban and rural voters about the importance of gun ownership and the need to restrict it for safety reasons.

He reminded reporters that Obama wanted “common sense” rules like an assault weapon ban and enforcing background checks for all gun purchases – including gun shows.

D.C. Circuit: Let’s Go To Trial on Nonresident Citizen Gun Purchase Ban

In a 2-1 opinion published today, Senior D.C. Circuit Court of Appeals Judge A. Raymond Randolph said that:

the [District of Columbia] district court’s grant of summary judgment in favor of the United States is vacated with respect to plaintiff Dearth and plaintiff Second Amendment Foundation, Inc. (insofar as its claim is based on Dearth’s standing), and the case is remanded for trial.

As stated in the opinion:

The question in this case is whether a citizen who permanently resides outside the United States has a right under the Second Amendment to the United States Constitution to purchase a firearm for self-defense while he is temporarily visiting this country. Dearth alleges that 18 U.S.C. § 922(a)(9) & (b)(3) and implementing regulations, 27 C.F.R. §§ 478.29a, 478.96, 478.99, 478.124, are unconstitutional because the provisions, in effect, prohibit citizens not residing in any state from purchasing firearms.

WaPo: Manchin, Toomey both interested in reviving gun control push

In the wake of the Charleston shooting, Sens. Joe Manchin (D-W.Va.) and Pat Toomey (R-Pa.) are considering ways to renew their failed push to pass meaningful gun control legislation.

In separate interviews Tuesday night, at a reception before a ceremony hosted by Sandy Hook families where Toomey was honored, the senators discussed their desire to find a new way forward.

“We want to make sure we have the votes. Pat’s going to have to, and I’ll work with him, to get some of our colleagues on the Republican side,” Manchin said, adding he hasn’t talked directly to Toomey about a revival.

AP: Appeals court says US citizen abroad can challenge gun ban

The Associated Press reports:

A federal appeals court says a U.S. citizen living in Canada should have a trial to challenge a federal law that bans people living outside the country from buying guns when they come back to visit.

The U.S. Court of Appeals for the District of Columbia Circuit ruled 2-1 Tuesday that a lower court should not have upheld the law without giving Stephen Dearth a chance to fully present his case.

Dearth claims the ban is unconstitutional because it prohibits citizens who don’t reside in any state from buying firearms.

Detroit restaurant employee shoots robber, saves customers

A worker at a Detroit Coney Island shot and killed a robber Sunday morning after the man walked into the restaurant with a gun and announced a robbery in front of customers.

Police say the robber was an adult man who was attempting to rob the Pete’s Grill and Coney Island at 1400 East Outer Drive on the city’s east side.

“Next thing I know, I saw everybody getting down on the ground,” said Robert Felton, of Detroit, who was inside the restaurant during the robbery. “This guy was robbing the place. He had the gun on everybody. He was telling everybody, ‘get to the register, I want the register.'”

….Felton told Local 4’s Nick Monacelli that the robber was telling everyone not to move and was waving the gun back and forth.

“It was a good thing, because the guy was threatening everybody,” Felton said. “There had to be at least 20 people in the restaurant. The guy that works here, he’s a hero. He’s really a hero.”

Guns.com: Keep a lookout for bogus Form 4s warns ATF

The Bureau of Alcohol, Tobacco, Firearms and Explosives has put out a general alert to the public to keep an eye out for fraudulent tax registration forms being used to swindle would-be buyers of National Firearm Act-regulated firearms.

The ATF warns that there appears to be an online scheme to bait FFLs — gun shops — into putting down a deposit on one of these premium firearms with altered NFA Form 4s for a deposit and then never delivering any guns. When printed on a regular sheet of paper these false documents appear to have ATF approval, although a closer look may reveal more.

“A typical scam starts with a perpetrator (seller) claiming ownership of an NFA firearm through an altered Form 4,” warns the ATF. “If the FFL expresses interest, the seller then requests that the FFL pay a percentage of the money upfront via cashier’s check and the remainder of the money after the ATF Form 4 paperwork is finalized. All communication is done via email.”
