SAF Files the Sixth Lawsuit Challenging Governor Grisham’s Suspension of Second Amendment Rights

The Second Amendment Foundation has filed a federal lawsuit against New Mexico Gov. Michelle Lujan Grisham and four other officials on the grounds that the governor’s “emergency order’ prohibiting open and concealed carry in Albuquerque and surrounding Bernalillo violates the Second and Fourteenth Amendments of the U.S. Constitution.
Joining SAF are the New Mexico Shooting Sports Association, Firearms Policy Coalition and a private citizen, Zachary Fort, who resides in Bernalillo County.

New York’s SAFE Act and Red Flag Laws Put Up Legal Barriers to Mental Healthcare in the State
Former New York Governor Andrew Cuomo and the Democrat-dominated state legislature took the opportunity presented by the Sandy Hook school shooting and rammed through an abomination of a gun control bill — literally in the middle of the night — they laughably called the New York SAFE Act.
The bill — like all such legislation — was passed with accompanying huzzahs and great promises that this would be what the state of New York needed to finally do something about its “gun violence” problem and save countless lives.

New Mexico Carry Ban Lawsuits: Grisham Has Neither the Law or Local Support on Her Side

So far, two lawsuits have been filed challenging New Mexico Governor Grisham’s wacky executive order suspending the Second Amendment in parts of the state, and I strongly suspect more will be filed today. The complaints and motions for TRO/preliminary injunction (linked in this post) are very short and self explanatory, and I encourage people to read them.
Executive summary of both: Under the Supreme Court’s Bruen decision, categorical bans on public carry are clearly verboten.
Grisham Gave Challengers All the Ammunition They Need to Tear Down Her Unconstitutional Carry Ban
If Defendants’ contempt for the Constitution was not clear on the face of the [executive order] and [public health order], Governor Lujan Grisham’s further comments provide all the confirmation this Court needs. At the press conference announcing the Governor’s suspension of the Second Amendment and her usurpation of queenlike powers, she stated, “if there’s an emergency, and I’ve declared an emergency for a temporary amount of time, I can invoke additional powers. No constitutional right, in my view, including my oath, is intended to be absolute.
The Failed Strategy of the Defensive Mindset
Never throw the first punch and Fire only if fired upon are two pieces of pseudo-tactical advice that are thrown out so often that most people now parrot the phrases without ever thinking about what they really mean. When examined at the most basic level, the advice is often given by those who will not actually be involved in the anticipated conflict. Parents tell their kids, “never throw the first punch” and military officers issue orders for their troops to “fire only if fired upon.”
In both of those examples — the parent or the military officer — neither party is likely to be in actual physical jeopardy when their advice is applied.

Federal Register Publishes DOJ’s New Stealth Universal Background Check Rule for Public Comment
The Biden Department of Justice, under cover provided by John Cornyn’s disastrous Bipartisan Safer Communities Act, has moved to vastly expand the definition of people who are considered by ATF to be “engaged in the business” of selling guns. It’s a not-so-stealthy move toward backdoor “universal” background checks and closing the alleged “gun show loophole.”
The proposed rule was published in the Federal Register today, which officially opens the requisite 90-day public comment period.
SIG SAUER Issues Safety Bulletin About the P320 and Certain Light-Bearing Holsters
SIG SAUER is reminding consumers about the risks associated with the use of light-bearing holsters, which have been involved in a number of alleged unintentional discharge incidents. Due to the large openings in these holster designs around the trigger (necessary for accommodating the bezels of attached weapon lights), fingers or foreign objects may be able to enter these holsters and contact the trigger. This vulnerability may be exacerbated by the use of a light-bearing holster without a compatible weapon light attached.

Oklahoma Sheriff Opens an Investigation Into ATF SWAT Raid on FFL’s Home

Oklahoma’s Pushmataha County Sheriff’s Office has opened an investigation into the ATF for their recent SWAT raid of one of their county’s most respected residents, Russell Fincher, PCSO Undersheriff Dustin Bray said Tuesday.
No one at the ATF warned the Sheriff’s Office in advance that highly armed federal agents would be conducting the SWAT raid, the Undersheriff said.
We weren’t apprised of anything,” Bray said. “We are a Second Amendment County and we are going to protect our citizens here.
After Sweetheart Deal Collapses, Fed Will Indict Hunter Biden on Illegal Gun Possession Charges
Federal prosecutors will seek an indictment of Hunter Biden for illegally possessing a gun as a drug user by Sept. 29, according to a new court filing on Wednesday.
Biden is expected to be charged in Delaware with felony counts related to his purchase of a gun in October of 2018. At the time, he has said he was regularly using crack cocaine. Prosecutors said last month that they also plan to charge the president’s son with tax crimes in California or Washington, D.C.

GOSAFE Introduces Their New Mobile Mag and Mobile Safe Firearm Storage Solutions
We first ran across GOSAFE’s lockable magazines at SHOT earlier this year. GOSAFE makes two products, a magazine and a “mobile safe.” The GOSAFE Mobile Mag is a 10-round lockable magazine for GLOCK 17, 19 and 34 pistols (more models to come in the future). The Mobile Safe looks like the Mobile Mag, but is a solid piece of plastic for the same guns that doesn’t load rounds, but locks and prevents a pistol from being used.
