VA Federal Judge: 18-20 Year Olds Can Purchase Handguns From FFL Dealers

Thu, 05/11/2023 - 15:25

A federal judge in Virginia on Wednesday declared unconstitutional a set of federal laws and regulations that prohibit federally licensed firearms dealers from selling handguns to 18- to 20-year olds, finding the measures violated the Second Amendment.

“Because the statutes and regulations in question are not consistent with our Nation’s history and tradition, they, therefore, cannot stand,” U.S. District Judge Robert E. Payne, who sits in Richmond, concluded in a 71-page opinion.

WA Ban Won’t Hold Up To Scrutiny

Mon, 05/08/2023 - 14:33

Less than two weeks ago, Washington became the tenth state in the nation to ban so-called “assault weapons.”

And while the ink was still drying on Washington Gov. Jay Inslee’s signature, the new law was already challenged in federal court. All that remains to be seen is how the legal system will look upon Washington’s law.

On April 25, Inslee signed Substitute House Bill 1240, making it illegal for any person in Washington to “manufacture, import, distribute, sell, or offer for sale any assault weapon,” with some minor exemptions.

Cheap Suits

Mon, 05/01/2023 - 10:20

If you go by the number of lawsuits in the news these days, you’d think they were as cheap as the sale rack at a Men’s Warehouse.

They’re not.

Unless, of course, you’re one of the feckless ideologues in government service that seem to only be motivated by the passage of eyewash legislation.

As you saw demonstrated most recently, Washington State and its legislature have more than a few of these folks. Unfortunately, they’re accompanied by a governor more than willing to go along with what is really nothing more than ideological posturing.

I’m referencing the passage -and Governor Jay Inslee’s signing of HB1240. Another new law that bans the sale of modern sporting rifles, along with many other firearms.

Doesn’t seem to bother the governor nor the legislature that their legislation has little chance of surviving a legal challenge. Much less the two already filed. The challenges came from the Second Amendment Foundation and the National Shooting Sports Foundation shortly after Inslee’s signing HB1240 into law.

WA To Ban Semiautomatic Rifles

Thu, 04/20/2023 - 14:56

The Washington State Legislature on Wednesday sent a bill to Democratic Gov. Jay Inslee’s desk that will ban semi-automatic rifles.

The measure, which Inslee is expected to sign into law, will “block the sale, distribution, manufacture, and importation of more than 50 gun models, including AR-15s, AK-47s, and similar style rifles,” the Associated Press reported. Sales to law enforcement agencies and the military are excepted from the law, and individuals who already possess these kinds of weapons will be able to keep them.

Texas In Bed With ATF

Wed, 04/19/2023 - 09:56

Texas secretly gives its citizens’ incomes to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). Documents show this has led to at least one person being monitored by the feds without a warrant through the federal gun background check system. The Texas Workforce Commission (TWC) told The Epoch Times that it has written contracts with ATF for “sharing income information” for criminal investigations. The revelation may lead to oversight by the legislature.

Texas state Rep. Briscoe Cain, a Republican, is “deeply troubled” about this coordination with the state’s unemployment agency and federal government.

“My office will be looking into whether the Texas Workforce Commission is assisting the ATF in the Biden Administration’s mission to violate the constitutional rights of law-abiding Texans,” Cain told The Epoch Times after reviewing the emails obtained by Gun Owners of America (GOA) as part of its ongoing FOIA lawsuit.

Gun Safety Defines The John Wick Franchise As Much As The Weapons Do

Thu, 04/06/2023 - 10:18

Of the many weapons that mythic assassin John Wick has used to kill hundreds of bad guys over the span of four movies (a book, a pencil, a wire, a car door, a horse, an axe, drums), a gun still best defines him — and the series.

“No one does guns more than we do,” said “John Wick” director Chad Stahelski, a former stuntman. With the four films in the franchise, Stahelski has taken “gun-fu” (a balletic blend of martial arts and gunfighting) to new commercial and creative heights even as the use of guns on set has become hotly debated since the death of “Rust” cinematographer Halyna Hutchins.

House Judiciary Postpones Pistol Brace Rule Markup After Nashville Shooting

Tue, 03/28/2023 - 10:52

The House Judiciary Committee postponed a scheduled Tuesday markup on a resolution to nullify a Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) pistol brace rule following the mass shooting at a Nashville, Tennessee, school on Monday.

“Democrats were going to turn this tragic event into a political thing,” Judiciary Committee Chair Jim Jordan (R-Ohio) told The Hill on Monday evening.

Congressional Witness Admits Bloomberg Gun Control Group Asked ATF for Pistol Brace Rule

Fri, 03/24/2023 - 15:49

Rep. Jim Jordan (R-OH) questioned Everytown for Gun Safety’s federal legal director Rob Wilcox during Thursday’s House Judiciary Committee hearing and learned that the Bloomberg-affiliated gun control group actually asked the ATF to take action on pistol stabilizer braces.

Jordan asked Wilcox, “Did you or anyone in your organization communicate with the ATF or the Biden administration about these issues we are discussing today, prior to the notice of proposed rulemaking?”

Wilcox responded, “We submitted a formal petition for rulemaking through the formal channel, sir.”

Jordan then pressed for certainty, asking, “Before the notice of proposed rule making?”

Wilcox responded, “That’s correct.”

Amicus Brief Filed Challenging ATF Pistol Brace Rule

Wed, 03/01/2023 - 10:37

Republican Tennessee Sen. Marsha Blackburn filed an amicus brief that states the Bureau of Alcohol, Tobacco, Firearms and Explosives’ (ATF) new pistol brace rule infringes on the Second Amendment.

The Daily Caller first obtained the briefing, which was officially filed Feb. 27 in the United States District Court for the District of North Dakota. Blackburn was joined by thirteen Republican Senators and dozens of House Republicans to fight the ATF after they enacted a rule that would make pistol stabilizing braces illegal for anyone without a certain license.

The rule would make gun owners face the possibility of being charged with a felony if they do not register their firearms with the stabilizing braces.

In the amicus brief, the lawmakers contend that the rule was never authorized by Congress and violates separation of powers principles.

Everytown Loses Again

Fri, 02/17/2023 - 11:34

It should come as no surprise that anti-Second Amendment activists will do and say anything to push their agenda, including using tragedy to further their cause. Following a 2018 shooting in Santa Fe, Texas, the activists at Everytown Law saw an opportunity to do just that. The Michael Bloomberg-funded group spearheaded a lawsuit against Lucky Gunner with one clear goal: to drive us out of business. They failed. This week, we announce the dismissal and settlement of that lawsuit.

We spent three years vigorously defending against this lawsuit and the many false allegations levied against our company and its employees. We refused to back down and were committed to fighting as long as necessary to prove we did nothing wrong.

Our loyal customers and suppliers know we follow the law. We are proud of that fact. In the end, a plaintiff and one of the victims of the shooting, Trent Beazley, even said, “Upon reflection and review of the facts, I believe that Lucky Gunner did not break a law.”

(Possible) Preventable Tragedy

Wed, 02/15/2023 - 13:35

Michigan Democrats are pushing for new gun control laws after three Michigan State University students were gunned down and several others were injured in a shooting Monday evening.

It is unclear whether additional laws will be any more effective than the existing gun laws that a Democratic district attorney failed to faithfully apply in full to the MSU shooter after his previous run-in with the law.

Former Ingham County District Attorney Carol Siemon not only pushed for Anthony McRae to avoid serious consequences and reacquire a weapon, but a general policy for other criminals as well.

They probably let their wife open the car door for them. And they definitely put their preferred pronouns in their email signature. For god’s sake, reach down and grab hold man!

H.R.374 (Abolish The ATF) Introduced

Wed, 01/18/2023 - 13:49

Rep. Matt Gaetz, R-Fla., introduced a bill to eliminate the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) following a controversial ruling that tightens regulations on pistol stabilizing braces.

The ATF issued its final rule Friday that will treat guns with stabilizing accessories like short-barreled rifles, which require a federal license to own under the National Firearms Act.

Attorney General Merrick Garland said the ruling enhances public safety, but Gaetz said it unfairly punishes disabled gun owners and veterans who rely on stabilizing braces to be able to fire with one hand.

Gaetz introduced H.R.374, the “Abolish the ATF Act,” Tuesday morning in response to the ruling, telling Fox News Digital it was the “final straw.”
